In a bold move to protect the sovereignty of the nation, a federal appeals court has put a temporary halt to the reckless actions of the Border Patrol in Texas. The 5th U.S. Circuit Court of Appeals has stepped in and issued an administrative stay against a lower court ruling that irresponsibly allowed the Border Patrol to cut through Texas’s vital razor-wire border fence. The judges have rightfully recognized the need to hear more arguments on this crucial issue before allowing such dangerous actions to continue.

Texas swiftly sought this delay after a lower court judge, although acknowledging the federal government’s deceptive conduct in cutting holes and ushering thousands of migrants through, erroneously ruled that the case was not within the court’s jurisdiction at this time. The Lone Star State is fighting to defend its border and prevent the chaos and danger that ensues from uncontrolled illegal immigration.
Texas has taken decisive action by installing miles of concertina wire on private property along the border, particularly near Eagle Pass, in an effort to deter dangerous crossings and direct migrants to official border crossings where they can be properly processed by federal officers. However, the federal government has repeatedly undermined these efforts by callously cutting through the wire to create an easier path for illegal entry.
In a particularly alarming incident, Border Patrol agents used a forklift to create a 20-minute hole in the wire, allowing over 300 migrants to illegally enter the country, despite none of them being in distress. These irresponsible actions by the Border Patrol jeopardize national security and undermine the rule of law. Judge Alia Moses rightfully acknowledged the Biden administration’s role in these dangerous border crossings but unfortunately dismissed Texas’ lawsuit on procedural grounds.
