The Emergency Medical Treatment and Active Labor Act (EMTALA) mandates that hospitals participating in Medicare and Medicaid must provide emergency care to patients regardless of their ability to pay. Patients who needed medical care could no longer be denied it because of a lack of financial resources, which was the initial purpose. As stated by the Biden administration, the federal statute, including limits on life-or-health exceptions, takes precedence over all state laws.
