Senator John Neely Kennedy of Louisiana once again showcased his knack for exposing the incompetence of President Joe Biden’s judicial nominees. During a Senate Judiciary Committee meeting, Kennedy posed a simple question to judicial nominee Sara E. Hill, expecting a basic understanding of the legal terms “stay order” and “injunction.” To Kennedy’s surprise, Hill stumbled over her words and failed to provide a clear answer.

It’s rather astonishing that someone aspiring to be a federal judge would lack knowledge of fundamental legal concepts. As President of JCN, Carrie Severino, pointed out, stays and injunctions are essential topics that district judges frequently encounter. How can we have confidence in Hill’s ability to make sound judgments if she fails to grasp such rudimentary principles?
In the video shared by Severino, it was even more disheartening to witness Senator Dick Durban congratulating Hill sarcastically for “passing the Kennedy bar exam.” This comment exemplifies the low expectations some Democrats have for Biden’s nominees and their willingness to disregard any shortcomings.
To clarify the difference between a stay and an injunction, a stay is an action taken by a court to temporarily halt legal proceedings or prevent a party from taking certain actions. On the other hand, an injunction is a court order that compels or prohibits an individual from engaging in specific actions. Both concepts are integral to the legal system, and any competent lawyer or judge should be able to explain them correctly.
Senator Kennedy should be commended for consistently challenging Biden’s nominees and ensuring they possess the necessary knowledge and qualifications for their respective roles. We need individuals with a deep understanding of the law and a commitment to upholding its principles, not individuals who falter at the most basic legal questions.
Hill, who has served as the former Cherokee Nation Attorney General and former Special Assistant U.S. Attorney, was nominated to become the Federal District Judge serving Northern Oklahoma. While she may hold degrees in law and has an impressive background, her inability to articulate foundational legal concepts raises concerns about her suitability for the position. As conservatives, we value a judiciary that remains faithful to the Constitution and possesses the expertise needed to interpret and apply the law accurately.
