According to Honig, if Trump were to win this case, it would essentially nullify the federal election interference charges brought against him by Special Counsel Jack Smith. This is a major blow to Smith’s investigation, which many Trump supporters have claimed is politically motivated rather than based on actual legal grounds. And you know what? They may just be on to something.
But the impact doesn’t stop there. Honig pointed out that Fani Willis’s state-level case against Trump could also be in jeopardy. After all, the principles of immunity apply across the board, whether it’s a federal or state-level prosecution. He filed a motion with the Supreme Court seeking an immediate decision on the complex issues surrounding presidential immunity from prosecution. And guess what? The Court actually granted his motion. Talk about speedy justice!
Now, this move by Smith may seem risky, but it’s all in an effort to ensure that the trial happens on time, which is scheduled for March 4. He wants to avoid any delays that might push the case past the upcoming presidential election. Can’t blame him for wanting to keep things moving. After all, time is of the essence.
If the Supreme Court ultimately rules in favor of Trump, especially on the grounds of presidential immunity, it could be a monumental victory for the former President. Not only would it vindicate him from these charges, but it could also set a precedent for future legal actions against a sitting or former President. And with the election less than a year away, this victory couldn’t come at a better time for Trump.
