Previously, the Fifth Circuit Court of Appeals had ruled in favor of the plaintiffs but had left gun owners at risk of committing a felony if they continued to possess their pistol braces. However, U.S. District Court Judge Matthew Kacsmarky of Texas has now issued a nationwide injunction, providing temporary relief for millions of law-abiding gun owners.

This decision saves gun owners from having to destroy their pistol braces or even their firearms. The Biden administration’s pistol brace ban had turned millions of innocent gun owners into criminals overnight, but now they can breathe a sigh of relief. Judge Kacsmaryk ruled that the ATF’s attempts to circumvent Congress and enforce regulations instead of existing gun laws were illegal. This includes the ban on pistol braces, which serve a practical purpose for disabled individuals and allow law-abiding gun owners to have shorter barrel guns without registering them as short barrel rifles.
The ban was put in place after a mass shooting, but it does nothing to actually prevent gun violence. Banning pistol braces, which are simply a piece of plastic, is a useless gesture that does not deter criminals. The focus on specific types of guns, like AR-15 setups, ignores the fact that most shootings still occur with handguns.
