Hunter Biden’s legal team is back at it again, filing what looks like a Hail Mary request for a new criminal trial on those federal gun charges. They’re claiming that the judge who oversaw the case had no authority to do so because some procedural technicality wasn’t addressed. It’s almost like they’re trying to get him off on a technicality rather than arguing the case's merits. Who saw that coming?
Earlier this month, a jury found Hunter guilty of three felonies related to his purchase of a gun in 2018. Let’s not forget he was hitting the crack pipe hard during that time. Federal law says drug users can’t own or possess firearms, but apparently, Hunter and his lawyers think that rule should apply to everyone else but him. No surprise there, right?

So now the appeal is arguing that since there was no formal federal circuit mandate, the trial should never have started. It’s all about the finer points of legal procedure, not about whether or not he did the crime. His team wants those convictions vacated, playing the legal game to the hilt. They’re saying the trial judge, Maryellen Noreika, jumped the gun. Pun was definitely intended.
Judge Noreika has been a busy bee, denying motion after motion from Hunter’s attorneys, who wanted to toss out the charges based on his supposed Second Amendment rights. The 3rd U.S. Circuit Court of Appeals has backed Noreika’s decisions so far, except on that unexplored Second Amendment question Hunter’s team is clinging to. Now Hunter’s lawyers say this unresolved appeal means the judge frigged up by seating a jury in the first place.
The back-and-forth legal wrangling is mind-numbing, but here’s the kicker—Attorney Abbe Lowell, Hunter’s knight in shining armor, filed and then quickly withdrew a similar appeal just last week without blinking an eye. It’s almost like they don’t believe their own argument. Meanwhile, Hunter’s already guilty of lying about his drug use on federal forms and illegally possessing a firearm. It sounds like they’re reaching for anything to get the poster boy off the hook for bad decisions. Being a Biden sure has its perks.
