U.S. District Judge Maryellen Noreika made quite a stir recently when she put an end to Hunter Biden’s cushy plea agreement for his tax and gun charges. And now, the consequences of her decision are starting to play out. One of Biden’s attorneys, Chris Clark, has asked to be removed from the case because he will likely be a witness at his client’s upcoming trial. Talk about a conflict of interest!
According to Clark’s motion filed last Friday, he cited Delaware Rule of Professional Conduct 3.7(a), which states that an attorney cannot act as an advocate if they are likely to be a necessary witness unless it would cause significant hardship for the client. Well, it seems that Clark believes stepping away is the best move, considering recent developments revolving around the plea bargain agreement that was scrapped.

I mean, can you blame him? The negotiation and drafting of the plea agreement are going to be contested, and Clark was right there in the middle of it. Sounds like he could be a pretty important witness to those issues. Former national security prosecutor and federal public defender Kash Patel says it’s to be expected, given the circumstances. He explains that any potential conflict of interest involving an attorney becoming a witness is grounds for removal. It doesn’t matter if it happens before or during the trial. The client would have to waive any conflicts for the attorney to stay on.
But wait, there’s more! Prosecutors are also making moves in this case. They want to transfer Biden’s prosecution to either California or Washington, D.C. They argue that the offenses he’s charged with do not fall under Delaware’s jurisdiction. Instead, the venue for these offenses and any related tax offenses lies either in the Central District of California or the District of Columbia. Looks like the prosecution wants to go where they believe they have the strongest case against Hunter Biden.
