Ohio Dems Warned: Biden Risks Missing Ballot Without Swift Action

According to reports, Ohio law sets a deadline for nominees for president and vice president to be certified or nominated, and this year the deadline falls on Aug. 7. However, the Democratic National Convention is not scheduled to start until 12 days after this deadline.

In the past, the state legislature has passed fixes to waive the deadline when it does not align with the convention, but Ohio House Speaker Jason Stephens has said there is not enough interest from the Republican Party to address the issue.

In response, Ohio Secretary of State Frank LaRose wrote the chairwoman of the Ohio Democratic Party to inquire about their plans to address the problem. LaRose expressed his concern for giving voters a choice in the presidential race and emphasized his duty to follow the law as Ohio’s chief elections officer.

Suppose no action is taken by the Democrats. In that case, their presidential nominee will not be on the Ohio ballot, and LaRose has called for a solution that upholds the law and respects the voters, given that the Ohio House speaker stated there would not be a legislative solution.

The options for Democrats may include suing to force Biden onto the ballot or finding a way to officially nominate Biden before the convention to meet Ohio’s requirements before the state deadline.

Republican Ohio Gov. Mike DeWine has expressed confidence that Biden will be on the ballot, suggesting that if the legislature does not act, the issue may be resolved through the courts.
