Raskin Urges DOJ to Force Alito, Thomas Recusal on Jan. 6 Cases

In a proposal from Rep. Jamie Raskin of Maryland, he suggested that Supreme Court Justices Samuel Alito and Clarence Thomas should step away from considering Jan. 6-related cases. Raskin argued that the Department of Justice should use the Constitution to force the two justices to recuse themselves.

Alito and Thomas have been under pressure to remove themselves from cases related to the events of January 6. The looming cases involve determining if former President Trump can be prosecuted for his actions during his time in office, and if hundreds of riot defendants were wrongly charged for obstructing the certification of President Biden’s victory.

Raskin insists that the DOJ can invoke the Constitution to demand the recusal of the justices, stating that the recusal statute is a binding command from Congress. He also expressed the belief that other justices on the Supreme Court can and should bring this matter to light, helping legitimize the process.

Raskin concluded by emphasizing the importance of following the Constitution and the recusal statute, stating that it is not optional for the justices to recuse themselves from cases where judicial bias is apparent.

It is worth noting that Thomas is facing calls to recuse himself due to his wife’s involvement in activities related to the 2020 presidential election, while Alito is facing similar calls over his residences flying flags that are purportedly connected to the January 6 riot.

These cases have caught the attention of Democrats who want the justices to recuse themselves, and Raskin’s suggestion adds to the ongoing debate surrounding these critical Supreme Court decisions.
