Attorney General Upholds Bathroom Restrictions – Safety for Women & Girls First!

Due to his position on the issue of transgender people's use of the bathroom, Ohio Attorney General David Yost has caused a stir. He stated that state laws do not provide adequate protection for people's preferences when it comes to using the bathroom that matches their gender identity.

In Ohio, it’s legal for public accommodations to provide a person with full enjoyment of their facilities based on their sex. But, this doesn’t mean that they can’t accommodate gender-specific facilities, which can make the establishments safer for women and girls.

In a Friday opinion, Yost stated that allowing men to share restrooms, locker rooms, and changing rooms with women makes it easier for biological males to victimize females.

According to Yost, when there are not separate facilities for men and women, people are less likely to report or notice men using the restrooms of women. This issue can pose a safety hazard to women. Therefore, it is important to maintain restrictions regarding the use of restrooms based on one's biological sex.

Although he acknowledges that transgender individuals have the right to feel disrespected or uncomfortable when they use the restroom according to their chosen gender identity, the law doesn't provide adequate protection for their subjective preferences. He stated that the law should protect people's objective measurements of equal access.

It's no surprise that the legislature in Ohio is considering legislation that would require public facilities to accommodate students using bathrooms that match their biological sex.

Yost's opinion reinforced the need for objective standards when it comes to public accommodations and the right of individuals to access them according to their gender identity. It also ensured the safety and privacy of biological females.
