Dozens of States SUE over Biden’s disastrous border policy

Republican Attorney General of Virginia Jason Miyares and a dozen other state officials sued the Biden administration on Monday over its plan to address the influx of migrants at the border. Their lawsuit was filed in response to a Trump-era executive order that ended on May 11.

According to the executive order, migrants who traveled to another country before reaching the US would not be eligible for asylum. But, according to Miyares, the rule provides some exceptions. These include individuals who claim that they're in danger back home and using apps to book entry appointments or having their requests denied.

According to the lawsuit, the Circumvention Rule provides that any provision that is not in compliance with the terms or applicable to any person or circumstance should be considered invalid. It also states that the court should not allow the implementation of these exceptions. Several Republican states, such as Arkansas, Florida, Tennessee, Wyoming, Idaho, and Alaska, joined the lawsuit.

According to the attorney general, the Biden administration's plan does not deter illegal immigrants and instead provides them with a manual that they can use to circumvent the immigration laws. He also noted that it encourages more border crossings and fosters human trafficking and the production of more opioids.

The DHS has not responded to the Daily Caller News Foundation’s comments on the lawsuit yet. In fiscal year 2022, the Border Patrol encountered over 2.2 million migrants at the U.S.-Mexico border. Meanwhile, in the first seven months of fiscal year 2023, the Border Patrol says that more than 1.2 million migrant encounters occurred at the southern border. Homestead Security Secretary Alejandro Mayorkas said that he disagrees with criticism from both Republicans and Democrats that the Biden Administration has failed to address the border crisis.

The states and the attorney general claim that the proposed plan will not deter illegal immigration and instead exacerbate the situation at the border, which will lead to more human trafficking and the production and sale of more opioids. It will also destroy Virginia's communities.
