As per a Supreme Court filing, the Texas Department of Public Safety assumed control of Shelby Park in Eagle Pass, Texas, allegedly preventing Border Patrol agents from overseeing the area. The administration contends that the Texas National Guard obstructed agents from rescuing two stranded migrants on the Texas side of the river. However, it is crucial to emphasize that the blame lies squarely with the Biden administration's failure to secure the border initially.

The acting supervisory border patrol agent reportedly sought entry to the area from the Texas National Guard to aid the distressed migrants but was denied, leaving the situation in the hands of Texas authorities. While Mexican authorities ultimately rescued the stranded migrants, three others had tragically drowned in the river just an hour prior.
