n a scathing rebuke, Republican leaders in Congress blasted the Justice Department’s decision not to prosecute President Joe Biden for his mishandling of classified documents. House Speaker Mike Johnson (R-LA), House Majority Whip Tom Emmer (R-MN), and House Republican Conference Chairwoman Elise Stefanik (R-NY) condemned the special counsel’s choice, calling it a glaring example of a two-tiered justice system. They expressed outrage that Biden could escape charges while former President Donald Trump faces a staggering 40 counts related to mishandling classified materials and obstructing justice.
This bombshell revelation comes after a year-long investigation into Biden’s mishandling of classified documents from his time as Vice President and in the Senate. The report by special counsel Robert Hur confirmed that Biden did indeed willfully retain and disclose classified materials, exposing serious risks to national security. Despite this, the report concluded that Biden’s actions did not amount to criminal conduct, leaving many Republicans seething with anger and frustration.

House Intelligence Committee Chairman Mike Turner (R-OH) and House Oversight Committee Chairman James Comer (R-KY) were quick to voice their outrage, pointing out the glaring hypocrisy in the Justice Department’s handling of the two cases. Turner lambasted the decision as evidence of a two-tiered justice system in Attorney General Merrick Garland’s Department of Justice, while Comer vowed to continue the Oversight Committee’s investigation to bring transparency and accountability to the American people.
Even some of Trump’s allies in the Senate joined the chorus of criticism, with Sen. J.D. Vance (R-OH) slamming the glaring disparity in treatment between Biden and Trump. Vance decried the criminal justice system as a joke and urged his colleagues not to roll over for DOJ nominations in the Senate.
However, several Democrats rushed to the defense of the Justice Department’s decision, arguing that the circumstances surrounding Biden and Trump’s cases were vastly different. Sen. Richard Blumenthal (D-CT) dismissed claims of a double standard, while Senate Majority Whip Dick Durbin (D-IL) praised Biden for fully cooperating with the investigation, unlike his predecessor.
