The Biden administration strikes again with its sneaky tactics and disregard for the rule of law. Acting Secretary of Labor Julie Su, who has yet to be confirmed after a whopping 218 days, has been quietly placed in the line of succession on the White House website. This move has raised serious concerns among 30 Republican senators, who have sent a letter to President Biden demanding answers.
Julie Su Was Never Confirmed as Secretary of Labor, So How Is She in the Line of Succession?

It’s beyond comprehension that the White House would think that someone who hasn’t been confirmed by the Senate could be eligible to assume the presidency. This blatant disregard for congressional intent and the law is a slap in the face to our system of governance. The Republican senators rightfully point out that the power to set the presidential line of succession lies with Congress, not the Biden administration. The Presidential Succession Act of 1947 clearly states that Cabinet members can only be in the line of succession if they are appointed with the advice and consent of the Senate.
Despite the Senate declining to confirm Acting Labor Secretary Julie Su these past 218 days (and counting), the White House now lists her in the presidential line of succession. I led 29 colleagues in demanding an explanation.

If you've never been an employer, balanced a budget, or signed both sides of a paycheck, you have no business being the next Secretary of Labor. #SayNoToSu pic.twitter.com/plALOgzfgY

But the Biden administration seems to think it can just ignore those pesky little details and do whatever it wants. This is yet another example of the Democrats’ unchecked power grab and their disdain for the Constitution. It’s no wonder that many have called for Su’s nomination to be withdrawn altogether. She has already shown a complete lack of qualifications and now the Biden administration wants to elevate her to a position of even greater power.
And let’s not forget about Su’s role in California’s unemployment insurance fraud and her support for California’s disastrous AB 5 law. She has been a champion of policies that harm small businesses and independent contractors, all while claiming to be a champion for workers. It’s clear that Su is not fit to lead the Department of Labor, let alone be in the line of succession to the presidency.
It’s time for the Biden administration to come clean and clarify its position on Su’s eligibility for the line of succession. The American people deserve transparency and accountability, not backdoor deals and power grabs. The Republican senators who have spoken out against this egregious abuse of power should be commended for their efforts to hold the Biden administration accountable.
But we can’t stop there. We must continue to demand answers and push back against the Democrats’ constant disregard for the Constitution and the will of the American people. Our system of governance depends on it.
