Conservative legal voices are rightly furious that the Senate has left the country vulnerable by allowing key U.S. attorney slots to remain empty while partisan games continue in Washington. On Wednesday, attorneys Victoria Toensing and Joe diGenova blasted Republican inaction on The Chris Salcedo Show, arguing that their party is failing to defend the rule of law and President Trump’s nominees.
Toensing called the situation “disgusting” and pointed out the stunning fact that only a handful of U.S. attorneys have been confirmed compared with the earlier pace under the Biden administration. That abysmal confirmation record is not rhetoric — it is a raw, preventable consequence of Senate timidity that endangers prosecutions and public safety.
The old blue-slip courtesy that allows home-state senators to block prosecutors has been weaponized by Democrats, and even an acting appointee in New Jersey stepped down amid the obstruction. The chokehold that procedural niceties have become is being exploited to prevent qualified conservatives from taking the bench and enforcing the law.
Toensing was blunt: with a Republican majority under John Thune, the Senate has the votes to get these nominees confirmed and should not be allowed to break for the holidays until the work is done. If 53 votes can’t be marshaled to stand up for sensible nominees, voters deserve to know which senators prefer press releases over action.
Enough with the bipartisan virtue signaling that leaves judicial and prosecutorial vacancies wide open; Senate leaders have already floated changing rules to stop obstruction and push through stalled nominees. If Democrats continue to bottle up confirmations, Republicans must be prepared to use every parliamentary tool to restore a functioning justice system rather than bow to old norms that only serve the swamp.
This is not a gamesmanship debate — it’s about who enforces the law in American communities, and conservatives should not cede that authority through cowardice. Senator Thune and Republican leadership were elected to deliver results, and it’s time they stop making excuses and start confirming vetted, qualified prosecutors and judges who will secure our streets and uphold the Constitution.
Hardworking Americans should be outraged that petty process has trumped public safety, and they should hold their senators accountable at the ballot box if Republicans fail to act. The GOP must remember that the next election will reward courage and punish complacency, so get these nominees confirmed or be prepared to explain why you chose compromise over country.
