In a bold move against Biden’s radical transgender agenda, Missouri Attorney General Andrew Bailey has taken legal action against the Department of Health and Human Services (HHS). The lawsuit, filed on Wednesday, challenges a rule that effectively forces health care professionals into performing sex change surgeries. This mandate, handed down under the so-called Affordable Care Act, tramples on the freedoms of health care providers who dare to uphold traditional values.
HHS, with its April 26 rule, declared that any health care or insurance provider receiving federal funding must not refuse care based on gender identity or sexual orientation. This, of course, means that religious hospitals and conscientious doctors are backed into a corner: perform these controversial procedures or face severe penalties. Six other states and the American College of Pediatricians have joined Missouri in asking the court to put a stop to this overreach.

Doctors and states, as the plaintiffs argue, should not be coerced into participating in what many see as harmful and unnecessary procedures. The rule is seen as an infringement on their First and Fifth Amendment rights and is deemed an overstep of Congress’s enumerated powers under Article I of the Constitution. Attorney General Bailey’s office minced no words in stating that this rule not only overextends federal authority but also intrudes on the rights reserved to the states.
The lawsuit accuses Joe Biden of once again stretching the bounds of his legal authority, threatening to cut off federal funding to any healthcare provider refusing to comply with these gender-transition mandates. Through the Missouri Save Adolescents From Experimentation Act, which went into effect last August, the state has already barred sex change surgeries on minors until at least 2027, pushing back against what they term as dangerous experimentation on children.
Joining Missouri in this battle for medical freedom are Arkansas, Idaho, Iowa, North Dakota, South Dakota, and Utah. These states are standing firm against a federal government that aims to undermine their autonomy and punish those who refuse to partake in this latest social experiment. The fight continues, with many watching closely to see if more states will take a stand against this federal overreach.
