The crux of the issue lies in the disagreement over whether U.S. border agents should be allowed to cut the wire in emergency situations without notifying the state. Texas agrees that cutting the wire for emergencies is justified, but claims that Border Patrol has been cutting it for other, non-emergency reasons. As a result, Texas has taken the matter to court, accusing the federal government of trespass and violating the Administrative Procedure Act.
Interestingly, Attorney General Merrick Garland tried to dismiss the case by claiming immunity, but his argument was rejected by the appeals court based in New Orleans. The court found that Border Patrol had exceeded its authority by cutting the wire for reasons other than emergencies.
To the surprise of many, the Supreme Court has now issued a temporary stay on the injunction, allowing the Biden administration to move forward with opening Texas’s border barrier. Even if Texas eventually wins the case, the damage may already be done. The thought of cutting the concertina wire to allow a massive influx of illegal immigrants to enter through a gaping hole seems far-fetched. So, it begs the question: Is Texas merely quibbling over a minor issue that won’t have a significant impact on the overall situation?
Nevertheless, this ruling could set a precedent for future decisions regarding the authority of the federal government versus that of the states. Until a final decision is reached, the federal government will continue to have the upper hand and can act as it pleases with regards to Texas’s border wire.
