On Tuesday, Ken Paxton, the attorney general of Texas, sued the Department of Health & Human Services, claiming that it had issued an unlawful directive requiring pharmacies to provide abortion pills.
In 2022, the Department of Health and Human Services (HHS) issued guidance to prevent pharmacies from discriminating against women. The guidance was based on a federal anti-discrimination statute, and it threatened to cut off funding to those that don't comply.
In July, the Department of Health and Human Services (HHS) issued a guidance stating that pharmacies are prohibited from discriminating against customers based on their race, national origin, sexual orientation, and disability.
According to Paxton, this regulation was part of the Biden Administration's campaign against the Jackson Women's Health.
"According to Ken Paxton, the Biden Administration has no legal power to implement an abortion agenda, and it is threatening to cut off federal funding to pharmacies in order to intimidate them into providing the controversial procedure. He noted that several states have already passed laws protecting the unborn."
In response to the unlawful guidance issued by the Department of Health & Human Services, I am filing a lawsuit against the agency. It seeks to stop the implementation of the regulation, which would force pharmacies to become abortion-on-demand facilities.

"The lawsuit claims that the actions of the Biden Administration are neither legal nor practical. They attempt to interject themselves into a matter that belongs to the people, and it undermines the obligation of pharmacies to follow Texas law."
The lawsuit was filed as a result of a case involving the FDA's approval of a drug used in chemical abortions. In this case, the plaintiffs claim that the agency does not have the authority to approve the use of mifepristone.
Around half of all abortions in the US are performed using chemical methods.
