Federal Court Blocks Biden Administration’s Title IX Regulations in Four States

In a blow to the Biden administration’s Title IX regulations, a federal court in Kansas has blocked the implementation of the controversial rules in four states. Judge John Broomes sided with the attorneys general of Kansas, Alaska, Utah, and Wyoming, emphasizing that Title IX was intended to safeguard biological women from discrimination in the realm of education.

The Department of Education’s new regulations, which sought to broaden the scope of sex discrimination to encompass gender identity and pregnancy while also mandating the use of preferred gender pronouns and banning single-sex facilities, have now hit a roadblock in a total of 14 states. Judge Broomes underscored the legislative intent behind Title IX, highlighting its focus on eradicating gender-based discrimination in educational settings and promoting equity for women.

The legal challenge leading to the injunction was supported by private organizations like Moms for Liberty, Young America’s Foundation, and Female Athletes United, who argued against the intrusion of gender ideology in public schools and championed parental rights in shaping their children’s education. The ruling shields students in the four states and extends its reach to schools attended by members of the aforementioned organizations nationwide.

Kansas Attorney General Kris Kobach hailed the court’s decision as a significant triumph in upholding the privacy and safety rights of girls and women, decrying the potential violation of these rights in shared facilities and defending the freedom of speech to acknowledge the biological fact of two sexes. With the rules also halted in states like Louisiana, Mississippi, Montana, and Idaho, the battle over the interpretation of Title IX continues to gather momentum, setting the stage for a wider debate on gender identity and parental authority in education.
