In another blow to the Biden administration’s feeble attempts to address the crisis at the southern border, a federal judge has struck down new asylum restrictions that were touted as a solution to illegal immigration. Judge Jon Tigar, an Obama appointee, ruled that the policy was not generous enough to “asylum seekers” – a term the judge throws around like candy at a parade.

The rule, known as Circumvention of Legal Pathways, was meant to incentivize immigrants to use the so-called “legal” channels created by the administration. But leave it to an Obama judge to undermine our efforts to secure the border. Judge Tigar deemed the rule “arbitrary and capricious,” as if he knows anything about the complexities of immigration policy.
Under the rule, immigrants were supposed to seek asylum in another country while in transit to the United States. A fair and reasonable expectation, one would think. However, the rule had plenty of exceptions, making it as loose as a goose. Immigrants could simply schedule a border appointment using a mobile app, or claim difficulty in using said app. It’s like the administration is rolling out the red carpet for those who want to exploit our already broken immigration system.
Judge Tigar had the audacity to suggest that the rule limited asylum in ways Congress never intended, thereby interfering with their apparent pro-amnesty agenda. He had the nerve to argue that we can’t justify limiting asylum by offering alternative pathways to legal immigration. How dare he expect people to follow the law?
The judge also claimed that seeking asylum in a country other than the United States is not a “viable option” for many immigrants. Oh really? Perhaps he forgot that Mexico is perfectly capable of providing safety and shelter for those in need. But of course, Judge Tigar seems to think that migrants are at “heightened risk of violence” in Mexico. Well, Judge, ever heard of the concept of personal responsibility? If they choose to enter a country illegally, they can deal with the consequences.
To add insult to injury, Judge Tigar criticized the CBP One mobile app and claimed it was unreliable due to technical issues and language barriers. Maybe he should spend less time nitpicking about minor inconveniences and more time acknowledging the tremendous efforts of our Border Patrol agents. They put their lives on the line every day to keep our country safe, while activist judges like Tigar sit comfortably behind their mahogany desks.
Despite this setback, Biden’s Department of Homeland Security has vowed to appeal the decision. It’s clear that they won’t let a little thing like the rule of law stop them from delivering consequences for unlawful entry. However, it’s high time they abandon their piecemeal approach and take real action to secure the border. Biden may try to paint himself as a border hawk, but his actions speak louder than his empty words.
Critics on the left have condemned the Biden rule for being a reboot of Trump’s agenda, even though it still had generous loopholes that allowed hundreds of thousands of immigrants into the country. It seems that no matter what policies are put in place, Republicans are always the ones expected to clean up the mess. Biden can claim that illegal border crossings are going down, but we all know it’s just smoke and mirrors. He’s trying to hide the fact that he’s funneling otherwise illegal immigrants through so-called “legal” channels to save face.
Let’s hope that when this case reaches the Supreme Court, there will be enough justices with the backbone to uphold the rule of law and put an end to Biden’s weak asylum policies. Our country deserves strong leadership and a secure border, not the misguided compassion of those who care more about the feelings of illegal immigrants than the safety and well-being of American citizens.
